Acceptance of Terms

By accessing or using MergeBadger ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service. We may update these terms from time to time; continued use after changes constitutes acceptance of the revised terms.

Description of Service

MergeBadger provides data-driven design tools for creating event badges, tickets, and other print-ready materials. You can upload data, design templates, map data to design elements, and export print-ready files. Features and availability may change.

Accounts and Eligibility

You must create an account to use certain features. You are responsible for keeping your credentials secure and for all activity under your account. You must be at least 18 years old (or the age of majority in your jurisdiction) and have the authority to bind yourself or your organization to these terms.

Acceptable Use

You agree not to use the Service to: (a) violate any law or third-party rights; (b) upload malicious code or content; (c) attempt to gain unauthorized access to our systems or other accounts; (d) resell or sublicense the Service without authorization; (e) use the Service for any illegal or fraudulent purpose; or (f) overload or disrupt the Service. We may suspend or terminate access for violations.

Your Content and Data

You retain ownership of content and data you upload. You grant us a limited license to store, process, and display your content solely to provide and improve the Service. You represent that you have the right to provide such content and that it does not infringe third-party rights. We do not sell your data. See our Privacy Policy for how we handle your information.

Our Intellectual Property

MergeBadger and its branding, software, and documentation are our property or our licensors'. You may not copy, modify, distribute, or create derivative works except as permitted by the Service's normal use. No license is granted beyond use of the Service in accordance with these terms.

Disclaimers

The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not guarantee uninterrupted, error-free, or secure operation. Print output quality depends on your design, data, and print provider; we are not responsible for print results.

Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, or profits. Our total liability for any claims arising from the Service is limited to the amount you paid us in the twelve months before the claim (or one hundred dollars if greater). Some jurisdictions do not allow these limitations; where prohibited, our liability is limited to the minimum permitted.

Termination

You may stop using the Service at any time. We may suspend or terminate your access for breach of these terms, for legal or operational reasons, or at our discretion. Upon termination, your right to use the Service ends. Sections that by their nature should survive (e.g. intellectual property, disclaimers, limitation of liability) will survive.

Changes to Terms and Service

We may change these terms or the Service. We will notify you of material changes (e.g. by email or a notice in the Service). Continued use after the effective date of changes means you accept the new terms. If you do not agree, you must stop using the Service.

General

These terms are the entire agreement between you and MergeBadger regarding the Service. They are governed by the laws of the jurisdiction in which we operate, without regard to conflict of law principles. Any dispute will be resolved in the courts of that jurisdiction. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a right does not waive it.
